I’m available and ready to work locally and everywhere in the continental USA . My standard fixed fees are comparable to or lower than national average fees and there is never a charge for mobilization or travel.

still available at no additional charge in Houston and all of Harris County, Galveston, Beaumont, Port Arthur
and all flood areas
In Houston, Harris County, Galveston, Beaumont, Port Arthur and all flood areas
virtually every Phase 1 Environmental Assessment requires investigation of more sites and also sites beyond standard search
distances. Also, data from the most reliable sources is less reliable and non-standard information takes longer
to process, and there’s more of it and it’s more important than ever before.
For the foreseeable future most or all Phase 1 Environmental Assessments in Houston will require greater effort, more time and
more critical thinking and assessment than ever before. It seems likely that some Phase 1 Environmental Assessment providers will
evaluate heavier workload and greater risk and raise prices.
We offer more investigation, longer assessments, more detailed reports with
no price increase and without significantly extending timelines.

ESA Phase 1 Environmental Assessment
We inspect and assess every type of commercial, industrial, institutional and multi-family
residential property locally and in every U.S. city and state.
One of the most important reasons
to purchase Phase 1 Environmental Assessment is to qualify to apply for federal
environmental liability protection should it ever become necessary to so.
The federal government recognizes the environmental risk that is inherent in every
property transaction. Even if a property has never had an environmentally sensitive
use on it, there is a virtual certainty that some property within ¼ mile, ½ mile or
farther away had, has or will have an environmental incident, and contamination can
travel through soil or groundwater to yours. If contamination is discovered on your
property regardless of where it originated or when, you will likely be liable for the
full cost of cleanup, unless you can document there was no contamination on the date
you took possession.
To assure you will qualify to apply for environmental liability
protection should it ever be necessary to do so, I include vapor investigation as part
of every Phase 1 Environmental Assessment and if necessary to assure you will qualify,
I will automatically perform ASTM E2600-10 Vapor Encroachment Survey if and as necessary
and at no additional charge.
We also perform ASTM E2018-15 Property Condition Assessment
which is building and property inspection plus estimates of probable cost for repairs and
upgrades and 10 year Capital Reserves Table of projected expenses for up to 10 years is
Property Condition Assessment is
also available at a separate service or at discount when ordered
together with environmental assessment. I have university degrees in architecture
and engineering, extensive industry training and over 30 years property inspection and
assessment experience. I offer Property Condition Assessment as a stand-alone service and
at a discount when combined with Phase 1 Environmental Assessment.
Member: ASTM Technical
Committee E50 Assessment, Risk Management and Corrective Action.
PCA Property Condition Assessment
For every type of commercial, industrial, institutional and multi-unit
residential real estate including retail, hotel, medical, educational, airport, marina, manufacturing,
warehouse and distribution property and more, I perform Property Condition Assessment (PCA) in conformance
with ASTM E-2018-15 Standard Guide for Property Condition Assessments: Baseline Property Condition
Assessment Process, which is the current and highest standard for property condition assessment.
Property Condition Assessment includes inspection of building structure including foundation, exterior
and interior walls, doors, windows; building systems including insulation, electrical, plumbing and HVAC
including furnaces, boilers and air conditioning and exterior and interior finishes.
Assessment also includes landscaping, parking, driveways and site amenities.
I always include estimates of necessary and recommended repairs and upgrades and can also provide
a Capital Reserves Table of annual budget amounts to cover required repairs, replacement, upgrades over
the next 10 years of ownership or lease. This feature allows the user and/or lender to project up to
10 years of costs for budgetary purposes.
Unlike a standard building inspection Property Condition
Assessment includes sidewalks, driveways and parking areas, landscaping and site amenities. A tier 1
ADA survey is also included.
Edward J. Devine, PCA Field Observer/PCR Reviewer is a Property Condition
Assessment professional with university degrees in architecture and engineering and post-university
industry training plus ongoing continuing education, and more than 32 years continuous experience
in architecture, engineering, property condition assessment and environmental assessment.
I carry $1,000,000.00 Professional Liability insurance.
My clients are commercial and industrial real
estate owners and buyers, attorneys, municipalities, development and housing authorities, attorneys,
HUD, FHA, SBA and banks and other lenders who regularly require Property Condition Assessment and
environmental assessment prior to loan approval.
NOTE: All facets of the assessment are completed
by a principal of the firm and you always have direct access by email and cell phone. No subcontractors,
no middleman, no excuses.
You can always rely on a quality work product by a competent, educated,
well trained professional with long experience and an excellent record of service.
I have a broad
range of university education, post-university training and experience including architecture,
engineering, construction, estimating, and building inspection and property condition assessment training;
property appraisal and mortgage banking; fire and casualty insurance claims and loss control;
environmental testing, analysis and vapor encroachment investigation, and as an arbitrator, legal
consultant and expert witness.
I also perform ASTM E1527-13 Phase 1 Environmental Assessment which
is the most current and highest standard for environmental assessment and qualifies the user to
apply for federal environmental liability protection, should it ever become necessary to do so.
Phase 1 Environmental Assessment is available as a separate service or at discount when ordered together
with environmental assessment.

Environmental Liability Protection
The federal government recognizes the environmental risk that is inherent in every property purchase Even if a property has never had an environmentally
sensitive use on it, there is a virtual certainty that some property within 1/4 mile, 1/2 mile or farther away had, has or will have an environmental condition
or incident, and there is a possibility that contamination from that site can travel underground to yours.
A satisfactory Phase 1 Environmental Assessment PLUS Vapor Encroachment Screening report meets or exceeds all requirements for due diligence and qualifies the user
to apply for federal environmental liability protections should it ever become necessary to do so.
- Qualifies user for federal environmental liability protection - innocent landowner or innocent purchaser defense 42 U.S.C. §§ 9607(b)(3) and 42 U.S.C. §§ 9601(35)
should it ever become necessary.
- Qualifies user for federal environmental liability protection - contiguous property owner liability protection 42 U.S.C. § 96079(q) should it ever become necessary.
- Qualifies user for federal environmental liability protection - bona fide prospective purchaser liability protection 42 U.S.C. § 9607(r) pursuant to the Small
Business Liability Relief and Brownfields Revitalization Act, Pub. L. No. 107-118 (2002), 42 U.S.C. §§ 9601 et. seq.
In the best interest of our clients,
we include Vapor Encroachment Screening whenever necessary and at no additional charge"
Low Cost Environmental Records Search and Risk Assessment
Low cost sites or sites perceived
as being at very low risk of contamination may
qualify for Enhanced Environmental Records Search & Risk Assessment. This form of assessment is often called
Preliminary Phase 1 but is sometimes the only assessment certain sites need. We dramatically improve report outcomes
by adding a geology/hydrology investigation to the standard inquiries. Our proprietary protocol exceeds industry
standards and requirements of Small Business Administration SOP 50 10 5(E) for eligible property types.
This form is often suitable for low price property and property perceived to be at very low risk for environmental
contamination. For industrial and commercial property and any property perceived to be at moderate to high risk for
contamination either generated onsite or on adjoining or nearby sites RSRA may be an effective pre-offer screening strategy.
When an offer is subsequently made and full Phase 1 Environmental Assessment is required, the entire RSRA fee is credited to
the standard Phase 1 fee.

Vapor Encroachment Screening
The new ASTM E 1527-13 Phase 1 Environmental Assessment Standard that went into effect on November 6, 2013
clarifies that a vapor investigation is necessary for you to meet all the standards of All Appropriate Inquiry (AAI) as defined by federal
statute 40 C.F.R. § 312.21(C)(1)to qualify to apply for liability protections should it ever be necessary to do so.
- To qualify user for federal environmental liability protection - innocent landowner or innocent purchaser defense 42 U.S.C. §§ 9607(b)(3)
and 42 U.S.C. §§ 9601(35) should it ever become necessary.
- To qualify user for federal environmental liability protection - contiguous property owner liability protection 42 U.S.C. § 96079(q) should
it ever become necessary to do so.
- To qualify user for federal environmental liability protection - bona fide prospective purchaser liability protection 42 U.S.C. § 9607(r)
pursuant to the Small Business Liability Relief and Brownfields Revitalization Act, Pub. L. No. 107-118 (2002), 42 U.S.C. §§ 9601 et. seq
Some form of vapor investigation is necessary to qualify a user for any of the CERCLA environmental liability protections and applications for
liability protection have and will be denied for lack of vapor investigation prior to time of purchase. Whenever a vapor encroachment condition is
detected or suspected by the standard vapor investigation we perform ASTM E-2600-10 Standard for Vapor Encroachment Screening because ASTM E 2600-15
is the only published and recognized screening methodology because it can be replicated. At USA Due Diligence Services this is a value added service
at no additional charge.
Vapor intrusion is a real business environmental risk. Over the past several years, there's been a growing body of evidence that chemicals
can penetrate building foundations at levels that raise health concerns for the occupants. There have been increasing numbers of lawsuits involving
vapor intrusion issues. According to an Environmental Bankers Association survey, vapor intrusion issues affect loan approvals for commercial,
industrial, institutional real estate-secured lending, commercial lending and multi-unit residential lending, and also trust activities.
If a vapor encroachment condition exists, Phase I Environmental Assessment without a vapor investigation component does meet the ASTM 1527-13 Standard
and does not satisfy the requirements of All Appropriate Inquiry (AAI) to qualify user to apply for federal environmental liability protections.
Contamination can travel as liquid, solid or vapor through soil and groundwater from a contamination source on site or off site within ASTM Standard search distances.
This is true even after contamination has been mitigated and only negligible levels of liquid or solid contamination remain. Vapor encroachment is known to be a significant
hazard and at least 32 states so far are now reopening all closed soil and groundwater contamination No Further Action (NFA) cases and where vapor contamination is found
the current owner becomes liable for remediation costs. A vapor investigation is required at time of purchase for every property type.
Edward J. Devine is a fully qualified Environmental Professional with
university education, post-university training, ongoing continuing
education and over 31 years continuous environmental assessment experience.
We Work for You, Not Your Lender
Did you know that lenders order environmental assessment that's better at protecting their interest
than yours?. In most cases, as a third party lender is exempt from
financial liability for contamination and their providers typically produce a low-cost report focused on evaluating lender's business risk for the term of the
loan. This type of assessment does not necessarily fully protect the borrower in case of
contamination, especially when contamination is discovered in the future. For instance, if vapor-related contamination is discovered on your site
in the future, you are
protected ONLY if a standardized and reproducible vapor investigation such as Vapor Encroachment Screening,
or equal, was completed prior to taking possession of the property.

Note: If your lender requires Phase 1 Environmental Assessment and/or Property Condition Assessment you
are required you to pay for
the service(s) and you have the legal right to insist on choosing your own qualified provider
who offers every service you need to fully protect you and the bank - rather
than from a bank's
list of providers.
To protect you and your lender we carry $1,000,000.00 liability and errors and ommisions insurance.
Upon request, we will provide a Reliance Letter and Certificate of Insurance to your lender.
Low cost environmental assessment from lender's providers NEVER include vapor encroachment screening. Environmental Assessment from USA Due Diligence Services always
includes vapor encroachment screening whenever necessary and at no additional charge.
Phase 1 Environmental Assessment with Vapor Encroachment Screening is
inexpensive assurance against future environmental financial liability.

mills in advance of adaptive reuse and retail outlets.
We have extensive
inspecting and assessing former public and religion school buildings in
Delaware, Rochester, New York and Newark and Jersey City New Jersey for Uncommon Schools, Inc., The French American
Academy and other private school and charter school organizations. We've
also done inspection and assessment work for off-campus facilities
in Alexandria, Virgingia for Virginia Tech, in Pennsylvania for East
Stroudsburg University and in New York for Rochester Institute of

USA Due Diligence Services has completed Phase 1 Environment Assessment and Property Condition Assessment
Reports on unusual and complex sites such as maintenance facilities on JFK International Airport property for a private maintenance
subcontractor taking over facility and operations management from jetBlue and
the Apple b>iPhone and iPad east coast returns center on Pennsylvania.
We've inspected and assessment multiple pharmaceutical and medical and facilities including at
least 3 plasma collection stations in North Carolina, Georgia and Florida.
Among the most unusual sites we’ve completed Phase 1 Environment Assessment and Property Condition Assessment
Reports were two gold refinery sites in New Mexico and three wastewater refinery sites in Virginia,
Tennessee and Illinois. We’ve also completed inspection and assessment reports on chain restaurants, free-standing
shopping center buildings and buildings owned and operated by public utilities including a power and light company.
And poultry and peanut farms.
We Can Get [Wherever] There [Is] From Here
Some sites are hard to get to but we’ve never failed to show up on site, no matter how hard it was to get there.
We’ve traveled thousands of miles to remote areas when no other provider was willing to
travel even a couple of hundred miles from the nearest major city. We’ve travelled to peanut farms in Alabama
and to the odd tool and die or other manufacturer with government contracts in Texas or Oklahoma or
bought up by a national or multi-national corporation, or funded by a national or international investor or lender.
We regularly work in seaside, mountainous and other resort areas to hospitality and recreational venues including
hotels, restaurants, ski areas, marinas, and camp and conference centers in California, Texas, Nevada, Florida, Michigan
and in the Catskills Of New York where we’ve completed Phase 1 Environment Assessment Reports on sites ocean side,
river front, desert and mountain top and valley.
OOur most unusual “commute” was to Fire Island, New York which as it turns out is accessible only by passenger
ferry. So when the GPS lady said “turn left onto the ferry” she actually meant “park in the lot, purchase a ticket and walk onto the
ferry – when it arrived at the dock.” There are no private automobiles on the Island, travel is by foot, bicycle or golf cart.
While there are year-round residents Fire Island is mostly a summer resort community.
We regularly travel by owned car and large and small airplanes and rental cars. In b>San Francisco, Chicago, Atlanta,
Washington, DC, Boston and New York we use rapid transit including high speed rail, subway, streetcar and trolley.
And we’ve worked places so remote we’ve had to hike in. In Florida we once arrived at an address to find much of the
property was ponds and swampland where nine alligators lived. The owner was kind enough to provide us with an ATV.
The owner neglected to mention the alligators until the end of day. Not sure how we feel about that, but we’re alive to tell
the story so it’s all good.
Our Fees Are Low
How do we keep our fees low? Because we travel extensively we earn lots of airline, hotel and car rental perks.
Rather than horde all those for our enjoyment we use them to keep your price low. USA Due Diligence Services is a low overhead
employee-owned business. We keep our costs low and distribute them evenly. According to annual surveys by Environmental
Data Resources (EDR) local Phase 1 Environment Assessment providers charge $200+ less than national providers. USA Due Diligence Services
is a national Phase 1 Environment Assessment and Property Condition assessment provider that charges “local” prices – or less – everywhere in the U.S.A.
We Work in the Biggest Cities and Smallest Towns…
We work often in the nation’s capital of Washington DC and have so far completed Phase 1 Environment Assessment and Property
Condition Assessment Reports in more than half of all state capitals including Phoenix, Denver, Hartford, Atlanta Boston, St. Paul,
Columbus, Austin, and Albany and the Capital Region. In Albany, Troy, and Schenectady we’ve performed ESA.on a variety
of sites including warehouses, office buildings, strip malls and plazas and also Albany Port Authority buildings occupied by private
corporations. On some of these sites we also performed Vapor Encroachment Screening and/or Property Condition Assessment.
…and the Most Remote Areas, Too
The U.S. has one of the world’s largest and most productive forest resources. Most of its forests are concentrated along the eastern
and western coasts and lake states, close to major ports. In states like Georgia, the Virginias, the Carolinas and the North Country
of New York we us a special form of assessment, ASTM E 2247 Standard Practice for Environmental Site Assessments: Phase I Environmental
Site Assessment Process for Forestland or Rural Property. We’ve also performed standard Phase 1 Environment Assessment and Property
Condition Assessment for other rural sites such as such as gas stations, inns
and auto parts chain store building as part of a 1031
Exchange, and a poultry farm.
We’ve Got New York Covered
Over the years we’ve worked in 46 of the 50 U.S. States and work often in New York. We work in the Binghamton – Vestal –
Johnson City – Endicott – Endwell area and up through Ithaca and Cortland and have inspected and assessed gas stations,
hotels, office buildings, medical centers and facilities, free standing dollar stores, restaurants, student housing and buildings in suburban
office and industrial parks, each of which we’ve provided Phase 1 Environment Assessment and Property Condition Assessment Reports.
From Utica to Syracuse and across the Finger Lakes Region including Auburn, Seneca Falls and Waterloo, Newark,
Geneva and Canandaigua including lakeside, winery, hotel and multi-family properties, USA Due Diligence Services has completed
Phase 1 Environment Assessment and Property Condition Assessment Reports. We’ve also inspected and assessed truck repair facilities,
gas stations, marinas and sites at risk of contamination migrating from nearby military installations.
In the Rochester area including Gates, Chili, Scottsville, Brockport, Batavia and down I-390 to Geneseo, Dansville
and Wayland, and from the Elmira – Corning area west through Hornell and Olean and over to Jamestown, Fredonia
and Dunkirk we’ve completed Phase 1 Environment Assessment Reports and Property Condition Assessment for aging urban industrial sites
for adaptive reuse, land for development, drycleaner sites, multi-family housing, warehouses, gas station/convenience stores.
We have also completed Phase 1 Environment Assessment and Property Condition Assessment Reports for charter schools occupying former
public and religious school buildings.
In the Buffalo area including Niagara Falls, Tonawanda, North Tonawanda, Amherst, Depew, West Seneca, East Aurora and
Ft. Erie USA Due Diligence Services has completed Phase 1 Environment Assessment Report and Property Condition Assessment on
multi-family housing, gas stations, warehouse, manufacturing and mill buildings, office buildings and hotels.
And we make day trips to states that are a short car or plane ride away including New Jersey, Pennsylvania, Ohio, and
Delaware to perform Phase 1 Environment Assessment and Property Condition Assessment. From our home airport we have direct daily
flights to and from New York City, Baltimore, Charlotte, Orlando and Tampa so Maryland, Washington DC, North Carolina and
Florida are all day trips for Phase 1 Environment Assessment and Property Condition Assessment. Don't worry about us! We travel
a lot and pretty far, and quickly and efficiently enough to be home most nights.
Wherever You Are and Wherever Your Site Is…
…We’re on the job. Most of our clients are buying the first and only commercial or industrial property they’ll ever buy and it’s in
their own home town. We also have local, regional and national clients with multiple sites in different states. And we have clients and
client companies in other countries who rely on us for Phase 1 Environment Assessment and Property Condition Assessment on sites they may
never visit. And you can rely on us too!
